Terms of Service

1. Acceptance of Terms

By accessing or using Kinetic Detective ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Kinetic Detective ("Company," "we," "us," or "our").

2. Description of Service

Kinetic Detective is a case management platform designed for licensed private investigators and investigative professionals. The Service includes web-based case management, investigator route logging tools, evidence capture, billing support, report generation, and associated mobile applications.

3. Eligibility

• You must be at least 18 years of age.
• You must be a licensed private investigator or work for a licensed investigative agency where required by law.
• You must have legal authority to enter into these Terms.
• You must comply with applicable federal, state, and local investigative laws.

4. Account Registration

You must create an account to access most features. You are responsible for maintaining credential confidentiality and for all activity under your account. Notify us immediately at agent@kineticdetective.com of unauthorized access.

5. Acceptable Use

You agree to use the Service only for lawful investigative purposes, including:

• Case documentation and management.
• Investigator route logging, session timing, and mileage tracking with proper legal authority.
• Evidence collection in compliance with applicable law.
• Generating professional reports for clients, attorneys, or courts.

6. Prohibited Conduct

You may not use the Service to:

• Stalk, harass, or harm any individual.
• Conduct surveillance in violation of wiretapping, recording, or privacy laws.
• Collect data on individuals without lawful purpose or required consent.
• Violate the FCRA, DPPA, or other consumer protection statutes.
• Reverse engineer, copy, or resell the Service.
• Attempt to gain unauthorized access to any part of the Service or infrastructure.

7. Your Data

You retain ownership of all case data, evidence, and client information you upload or generate through the Service. We do not sell your data to third parties, use your case files to train AI models, or share your data except as required by law or described in our Privacy Policy.

8. Payment Terms

Paid web or direct-service plans are billed outside the native mobile app on a monthly, annual, or separately agreed basis. The first native mobile launch does not offer in-app purchases, native checkout, billing portal access, or payment method updates. Fees are non-refundable except as required by law. We reserve the right to modify pricing with 30 days' notice. Failure to pay may result in service suspension.

9. Account Access

Access to the Service may be provided at no charge for selected users or during limited rollout periods. Accounts and features are provided "as is" unless a separate written agreement states otherwise, and may be modified, limited, or terminated according to these Terms.

10. Intellectual Property

The Service, including software, design, and content, is owned by Kinetic Detective and protected by applicable intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service for internal investigative purposes.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KINETIC DETECTIVE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless Kinetic Detective, its officers, directors, employees, and agents from claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or violation of law or third-party rights.

14. Termination

You may cancel your account at any time. We may terminate or suspend your account for violation of these Terms, non-payment, or any reason with 30 days' notice. Upon termination, you may export your data for 30 days, after which it may be deleted per our retention policy.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notice before they take effect. Continued use after changes take effect constitutes acceptance.

16. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles. Disputes shall be resolved in state or federal courts located in Salt Lake County, Utah.
